Terms and Conditions

1. Definitions

For the purposes of this document, the following definitions apply:

• Platform: the easyB Terminal software system and all its components, accessible via the web.
• User: any natural person who accesses the Platform after completing the registration procedure.
• Account: the set of credentials (email, password, PIN) and personal data associated with a User.
• Content: market data, charts, analyses, indicators, news and any other information made available by the Platform.
• Manager: the entity that owns and is responsible for the Platform.

2. Acceptance of Terms

Access to and use of the Platform is subject to the explicit acceptance of these Terms and Conditions. By checking the acceptance box during registration, the User:

• declares to be at least 18 years of age;
• declares to have read, understood and fully accepted these Terms;
• consents to the processing of their personal data as described in the Privacy Policy (Art. 11);
• undertakes to comply with all the provisions contained herein.

3. Description of Service

The Platform is a tool for personal analysis and monitoring of financial markets. It offers, among other features:

• interactive charts with technical indicators;
• customisable watchlists;
• market screener;
• data on stocks, ETFs, forex and options;
• graphical analysis and annotation tools.

The data displayed may be simulated, delayed or demonstrative. The Platform does not constitute a financial intermediation service.

4. Registration and Account

To access all features, an Account must be created. The User is required to:

• provide truthful, complete and up-to-date information during registration (first name, last name, email, phone number, ID photo);
• keep their access credentials confidential;
• not share the Account with third parties or use it for unauthorised commercial purposes;
• promptly notify the Manager of any unauthorised access to their Account.

The Manager reserves the right to verify the User's identity and request additional documentation at any time. The ID photo uploaded during registration will be associated with the User's identification badge on the Platform.

6. Permitted Use

It is forbidden to use the Platform for:

• illegal activities or those contrary to public order;
• attempting to access systems, data or unauthorised areas;
• spreading malware, viruses or other harmful code;
• collecting data from other users without consent;
• overloading or compromising the Platform's technical infrastructure.

Violation of these provisions entails immediate suspension of the Account and may be reported to the competent authorities.

7. Intellectual Property

All content of the Platform (source code, design, logos, graphics, texts) is the exclusive property of the Manager or the respective licence holders. Any reproduction, distribution or modification without prior written authorisation is prohibited. The User receives a personal, non-exclusive and non-transferable licence to use the Platform in accordance with these Terms.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Manager shall not be liable for:

• financial losses arising from the use of information available on the Platform;
• service interruptions, technical errors or data loss;
• unauthorised access to the User's Account caused by the User's own negligence;
• indirect, incidental or consequential damages of any nature.

9. Account Suspension and Closure

The Manager reserves the right to suspend or close a User's Account at any time, with or without notice, in the event of:

• violation of these Terms;
• provision of false or misleading information during registration;
• fraudulent or abusive conduct;
• request by the User themselves.

The User may request deletion of their Account at any time by contacting the Manager (see Art. 13).

10. Changes to Terms

The Manager reserves the right to modify these Terms at any time. Changes will be communicated to the User via email or notification on the Platform with at least 15 days' notice. Continued use of the Platform after this period constitutes acceptance of the changes. If the User does not accept the changes, they may request the closure of their Account.

11. Privacy Policy

The Manager processes the User's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and D.Lgs. 196/2003 (Privacy Code). The data collected during registration includes:

• personal details (first name, last name);
• email address;
• phone number;
• ID photo (profile image for the badge);
• usage data and access logs.

Purpose of processing:

• Account management and secure authentication (legal basis: performance of a contract);
• sending service-related communications (legal basis: legitimate interest);
• fulfilment of legal obligations (legal basis: legal obligation).

Data subject rights (Art. 15-22 GDPR):

• access to personal data;
• rectification of inaccurate data;
• erasure ("right to be forgotten");
• restriction of processing;
• data portability;
• objection to processing.

Data is not sold to third parties. It may be shared exclusively with technical service providers strictly necessary for the operation of the Platform (e.g. hosting and authentication services), bound by confidentiality agreements.

Data is retained for the period strictly necessary for the purposes of processing and in any case for no longer than 5 years from the closure of the Account, unless longer legal retention obligations apply.

12. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute arising from the interpretation or execution of these Terms, the parties undertake to seek an amicable solution. In the event of failure to agree, the Court of Milan shall have exclusive jurisdiction.
